Terms of Service

These Terms of Service ("Terms") are entered into by and between SrveAI ("SrveAI," "we," "us," or "our") and the individual or entity accessing or using our services ("you" or "Customer"). By accessing or using SrveAI, you agree to be bound by these Terms. If you do not agree, please do not use our services.

PLEASE NOTE: IF YOU SUBSCRIBE TO OUR SERVICES, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW FOR SUCCESSIVE BILLING PERIODS UNLESS YOU CANCEL AT LEAST 24 HOURS BEFORE THE END OF THE CURRENT PERIOD.

1. Definitions

  • "Services" means the SrveAI mobile application, website, and all related features and functionality.
  • "Customer Data" means any data, including photos, reviews, and preferences, that you submit through the Services.
  • "User-Generated Content" means reviews, ratings, and other content you create and share through the Services.
  • "AI Features" means features that use artificial intelligence, including restaurant recognition and recommendations.

2. The Services

2.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial purposes.

2.2 SrveAI Ownership

All rights, title, and interest in the Services, including all software, algorithms, AI models, and documentation, belong exclusively to SrveAI. No rights are granted except as expressly set forth in these Terms.

2.3 Free Services

Free Services are provided without charge up to certain usage limits. We may terminate or modify Free Services at any time without notice. FREE SERVICES ARE PROVIDED "AS-IS" WITHOUT ANY WARRANTY.

3. Customer Data

3.1 Your Ownership

You retain all rights to your Customer Data. You are solely responsible for the accuracy, quality, legality, and appropriateness of all Customer Data you submit.

3.2 License to SrveAI

You grant SrveAI a non-exclusive, worldwide, royalty-free license to use, process, and store your Customer Data to provide and improve the Services, prevent security issues, and as required by law.

3.3 Aggregate Data

We may create aggregated, de-identified data from Customer Data that does not identify you. We may use this data for our business purposes, including improving the Services.

4. User-Generated Content & Community Guidelines

4.1 Content Standards

By sharing content through the Services, you agree not to post:

  • Objectionable, offensive, hateful, discriminatory, or illegal content
  • Harassment, bullying, threats, or intimidation toward other users
  • Spam, fake reviews, or misleading information
  • Content that infringes on others' intellectual property rights
  • Personal information about others without their consent

4.2 Content Moderation

We review reported content within 24 hours and will remove content that violates these guidelines. Users who violate these guidelines may have their content removed and accounts suspended or terminated.

4.3 Reporting & Blocking

You may report objectionable content or block abusive users through the app. Blocking a user will immediately remove their content from your feed and notify us for review.

5. Restrictions

You shall not:

  • Modify, copy, or create derivative works of the Services
  • Reverse engineer, decompile, or disassemble the Services
  • Use the Services for any illegal purpose
  • Interfere with or disrupt the Services
  • Use automated tools to scrape or extract data from the Services
  • Share your account credentials with others
  • Create multiple accounts to circumvent restrictions

6. Subscriptions & Payments

6.1 Fees

Paid subscriptions are billed through the Apple App Store. All fees are non-refundable except as required by law or as expressly stated in these Terms.

6.2 Automatic Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store account settings.

6.3 Price Changes

We reserve the right to change subscription prices. Price changes will take effect at the start of your next billing period after notice.

7. AI Features & Disclaimers

7.1 AI-Generated Information

The Services use artificial intelligence to identify restaurants and provide recommendations. AI-generated information may be inaccurate, incomplete, or outdated. You should verify important information directly with restaurants.

7.2 Third-Party Data

Restaurant information is sourced from third parties including Google Places API. We do not control and are not responsible for the accuracy of third-party data.

7.3 Dietary & Allergy Warning

DIETARY AND ALLERGY INFORMATION IS AI-GENERATED AND SHOULD NEVER BE RELIED UPON FOR HEALTH DECISIONS. ALWAYS CONFIRM INGREDIENTS AND ALLERGENS DIRECTLY WITH RESTAURANT STAFF. SRVEAI IS NOT RESPONSIBLE FOR ALLERGIC REACTIONS OR HEALTH CONSEQUENCES.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SRVEAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Term & Termination

10.1 Term

These Terms remain in effect while you use the Services.

10.2 Termination by You

You may delete your account at any time through the app settings.

10.3 Termination by Us

We may suspend or terminate your account at any time for violations of these Terms, including posting objectionable content or harassing other users.

10.4 Effect of Termination

Upon termination, your license to use the Services ends immediately. We may delete your Customer Data, though some data may be retained in backups or as required by law.

11. General Provisions

11.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

11.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SrveAI.

11.3 Changes to Terms

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the modified Terms.

11.4 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
